YOUR PERSONAL DATA<br \/><\/strong>We will use your personal data in accordance with our privacy statement, which you can consult here.<\/p><p><strong>3. ORDER<br \/><\/strong>Free delivery within 3\u20137 working days for Belgium and the Netherlands on orders from \u20ac1,500 (excl. VAT).<\/p><p><strong>Is your order less than this minimum amount?<br \/><\/strong>We charge delivery costs for orders under \u20ac1,500 (excl. VAT). Is the delivery address located within a radius of 25 km from our store in Fl\u00e9ron? Then the delivery costs amount to \u20ac95 (excl. VAT). For addresses outside a radius of 25 km, a delivery fee of \u20ac135 (excl. VAT) is charged. The rate applicable to you is automatically calculated by our website when you enter your address.<\/p><p>You can place an order by selecting the desired item and following the steps on the screen. Before placing your order, you will have the opportunity to review it and make any necessary corrections. Your order will be confirmed as soon as you provide your payment confirmation.<\/p><p>The contract relates exclusively to those specific goods mentioned in our confirmation email regarding our acceptance of your order. Please read and verify this information in this email to ensure it is correct. If the details in the confirmation email are incorrect, or if you are not satisfied with the details in the email, please contact us via info@intermob.be. The contractual language is French. Where we accept your order, we have a legal obligation to deliver goods that are in accordance with these terms and conditions. The order is irrevocable for the buyer, and may under no circumstances be cancelled by the buyer, even before acceptance by Universal Meuble BV. The buyer deposits into our account, pays with Bancontact or pays cash in advance 30% or the full amount of the total price of the order. For custom-made \/ personalized orders, the customer pays 50% of the total amount. The payment of this advance or full amount applies as confirmation of the order.<\/p><p><strong>3-1. Intra-Community orders \/ deliveries (VAT-free)<br \/><\/strong>When you want to pay VAT-free, you only need to send us your company document (from your non-Belgian company) with your active intra-Community VAT number (KBIS extract) and a copy of your identity document. The VAT number must be valid according to V.I.E.S. (VAT Information Exchange System). The specified invoice address must be identical to the address linked to the VAT number.<\/p><p><strong>4. PRICES<br \/><\/strong>Information on this website regarding prices is subject to change by us, without prior notice. The prices displayed at the time of the order are the prices that apply. Although we take the utmost care to display prices correctly, it may occasionally happen that unforeseen price discrepancies occur due to internal system errors. In such cases, we are not obliged to deliver the goods at the incorrect price. If a price discrepancy is detected, we will inform you and offer you the opportunity to cancel the order, after which the amount already paid will be refunded. We may also request you to confirm whether you wish to proceed with the order at the correct price. If we do not receive a response from you or if you choose not to proceed with the order at the correct price, the order will be cancelled and the paid amount refunded. If the correct price of the goods is lower than the originally stated price, we reserve the right to proceed with the order and charge the lower amount upon shipment, at our sole discretion. Unless otherwise indicated, all stated prices are exclusive of VAT (if applicable) and exclusive of shipping costs. Delivery costs and Region information<\/strong><\/p><p><strong>5.1 Deliveries within Belgium<br \/><\/strong>With a minimum order of \u20ac1500 excl. VAT, we deliver for free within Belgium.<\/p><p><strong>5.2 When do you pay delivery costs?<br \/><\/strong>We charge delivery costs for orders under \u20ac1500 (excl. VAT). On the day of delivery, our driver will call you approximately 30 minutes in advance.<br \/>Note: For deliveries via an external transport company, the full invoice amount must be paid in advance. The driver cannot accept payments on our behalf upon delivery.<\/p><p><strong>5.4. Deliveries to the Netherlands<\/strong><\/p><p><strong>5.5 When do we deliver for free?<br \/><\/strong>With a minimum order of \u20ac1500 excl. VAT, we deliver for free to the Netherlands (note, for the following postal codes different rules apply under 5.3).<\/p><p><strong>5.6 When do you pay delivery costs?<br \/><\/strong>Do you order for an amount higher than \u20ac1500 (excl. VAT)? Then the delivery to the Netherlands is entirely free. Below this minimum amount, we charge a delivery cost of \u20ac135 (excl. If so, we will send you an adjusted quote with the delivery costs after you have submitted your order. Upon agreement, we will deliver your order.<\/p><p><strong>6. AVAILABILITY AND DELIVERY<br \/><\/strong>Information on this website regarding availability is subject to change without prior notice. We cannot guarantee the constant availability of the products on this site. All orders are at all times subject to current availability. We deliver within and outside Europe. For deliveries outside Belgium, we work with an external carrier. We deliver the goods ordered by you to the address you provide to us at the time your order is approved. Delivery will be made on the basis of the information on the product pages after your order has been accepted. We will make reasonable efforts to deliver the goods on the agreed date. If no date is stated, we will deliver the goods within 30 days after the day on which you placed your order and it was accepted by us. In case of unforeseen circumstances (for example, adverse weather conditions, unpredictable delays due to traffic jams, road works, diversions or mechanical breakdowns), we may not be able to deliver the goods within these periods and we are not liable for any delay or failure to deliver the goods if the delay is caused wholly or partly by such circumstances. In the event that a delivery does not take place, we will agree on an alternative delivery date with you. A penalty for exceeding the delivery term is out of the question, unless otherwise agreed in writing with the client. If one of the ordered products is out of stock, it will be placed on backorder and, once it is available from our suppliers, it will be delivered to the client or picked up by the client. If one of the products is out of stock at our supplier, and therefore delivered slightly later than the agreed delivery date, this will in no way entitle the client to a discount or penalty in favor of the client. We are also not responsible for any delay in delivery caused by the unavailability of someone to take delivery of the products. It is your responsibility to contact the post office or carrier regarding the goods that could not be delivered because you were unavailable.<\/p><p><strong>6.1. DELIVERY WITHIN YOUR PREMISES AND OR TO THE DOOR<br \/><\/strong>The purchased goods will, if the door is wide enough, be brought to the ground floor. If the goods do not fit through the door, the purchased good will be placed in front of the outer door. If our employees nevertheless out of goodwill transport the purchased products through the window or through any other place than the door, we are not responsible for damage caused to the delivered goods, interior or exterior or any other property of the client.<\/p><p><strong>6.2 Delivery \/ risk<br \/><\/strong>The risk of loss, destruction and\/or damage to the goods passes to the buyer at the moment of delivery.<\/p><p><strong>6.3. ARTICLE DAMAGED DURING DELIVERY<br \/><\/strong>We take the greatest possible care in processing your order. Should something nevertheless not be in order with your order upon receipt, you must report this to us in writing no later than 2 working days after receipt.<br \/>How do I report damage after receiving goods?<br \/>Send us a notification via email and include the following:<\/p><ul><li>Photos of the damage<\/li><li>Copy of the invoice<\/li><li>Copy of the delivery note from the carrier<\/li><\/ul><p>After receiving your damage form, you will receive a message from us within 2 working days whether it is justified. After the acceptance of the damage, we will contact you to handle the damage claim adequately.<\/p><p><strong>7. RETURNS AND EXCHANGES<br \/><\/strong>In case of cancellation of a standard order, an amount will be charged to the client to compensate for our costs, which has a value corresponding to 30% of the net selling price of the total invoice or order form for which a cancellation has been submitted. In case of cancellation of an order for custom-made or personalized work, this amount is 100% of the net selling price of the total invoice or order form that will be charged.<\/p><p><strong>8. PAYMENT<br \/><\/strong>The buyer is required to pay a deposit of 30% or the full amount to confirm the order. The deposit can be paid in cash, via Bancontact, or by bank transfer. For custom-made or personalized orders, a deposit of 50% of the total amount is required.<br \/>The remaining amount must be paid upon delivery. Payment can be made in cash (maximum \u20ac3,000) or by debit card, provided that transport is carried out by us. If an external transport service is engaged, the full amount must be paid prior to delivery. Payment can also be made in cash or by debit card at our location or by bank transfer to a bank account designated by us.<br \/>All payments must be made in euros, unless otherwise agreed. The day of payment is the day on which the payment is credited to our bank account. If payment is not made on time, we will be forced to hand over our claim for collection, which is deemed to take place two weeks after the due date. All costs associated with collection, including attorney, bailiff, and collection costs, both in and out of court, shall be borne by the client. Extrajudicial costs are calculated in accordance with the collection rate of the Belgian Bar Association, increased by the fee applicable to the proceedings. Payments by the client are first applied to interest and costs and subsequently to the outstanding invoices, starting with the oldest, even if the client indicates that the payment relates to a later invoice.<\/p><p><strong>9. WARRANTY<br \/><\/strong>A 1-year warranty is granted for new products. Universal Meuble BV warrants the sold goods and materials against any structural defect for a period of one year, calculated from the date of delivery. This warranty clause does not apply to normal wear and tear of parts. Also not covered by the warranty are: all defects resulting from poor maintenance, improper or rough use of the furniture. This one-year warranty period for new furniture may be unilaterally reduced if imposed upon Universal Meuble BV by the suppliers.<br \/>Interventions take place on working days from Monday to Friday from 09:00 to 18:00.<br \/>The buyer may assert (warranty) claims against us only if the warranty obligations regarding the goods supplied by us have not been assumed by third parties (such as manufacturers).<br \/>If the buyer has carried out or had carried out repairs and\/or modifications to the goods without prior, express, and written consent, any warranty obligation on our part shall lapse.<\/p><p><strong>10. <\/strong><strong>AGREEMENTS<br \/><\/strong>Agreements are only concluded after our express acceptance, which is evidenced by the written confirmation to the client or by the fact that we execute the agreement. Amendments or additions to the concluded agreement must be submitted to us in writing and must be accepted by us in the manner mentioned above.<\/p><p><strong>11. PAYMENT ARREARS<br \/><\/strong>All payment arrears automatically give rise to the exigibility of the amounts due and the granted discount, subject to costs. These costs include a surcharge of 10% of the amount due to compensate for administrative costs, with a minimum of \u20ac65.<\/p><p><strong>12. OWNERSHIP<br \/><\/strong>Purchased products remain our property until they are fully paid. As soon as the goods have been delivered to you or a third party designated by you, you bear the risk and are accordingly liable. Advances may be retained to compensate for any loss upon resale.<\/p><p><strong>13. LIABILITY<br \/><\/strong>Unless expressly agreed otherwise below, the statutory regulation regarding liability for defects applies. The above limitations and shortened terms do not apply to claims based on damage caused by ourselves, our legal representatives or agents:<\/p><ul><li>in case of injury to life, body or health<\/li><li>in case of intentional or grossly negligent breach of duty and in case of bad faith<\/li><li>in case of breach of essential contractual obligations, the fulfillment of which is indispensable for a proper execution of the agreement and on the fulfillment of which the counterparty to the agreement may normally rely (cardinal obligations)<\/li><li>within the framework of a given guarantee, insofar as agreed.<\/li><\/ul><p>We limit our liability to damage suffered by the client as a result of intent or fault on our part, and otherwise with due observance of the following. Consequential damage, such as damage caused by business interruption, however caused, is not eligible for compensation. If desired, the client must insure himself against this damage. The liability is otherwise limited to the invoice amount regarding the assignment. In deviation from the foregoing, if we are insured for the relevant damage, our liability is limited to the amount to be paid out by the insurer on the basis of that insurance.<\/p><p><strong>Used goods \/ Outlet (second-hand, Outlet)<br \/><\/strong>Goods that are not factory new are offered by us as used goods in the condition they are in at the time of sale. A purchase of a second-hand product therefore means that the buyer accepts every visible defect, so that after sale this cannot give rise to a return of the good.<\/p><p><strong>Installation and connection<br \/><\/strong>The stated prices are exclusive of installation, unless stated otherwise on the purchase agreement. Assembly services can be offered upon request. These services are not included in the product price and are performed on the basis of a personalized quote. The customer can request this service before purchase or delivery. An intervention is only scheduled after confirmation of a specific quote drawn up by our services.<\/p><p><strong>14. COMPLAINTS<br \/><\/strong>The buyer is responsible for the accuracy and completeness of and is responsible for the data he has provided to us. With regard to the data, sizes, color fastness and the like provided by us, the buyer must take into account the usual tolerances and minor changes in the goods delivered by us. The goods delivered by us may therefore deviate from the description in the order if and insofar as it concerns minor differences in size, differences in quantity and subordinate changes. Defects that were not externally perceptible at the time of delivery, nor could appear during a careful and timely check, must be reported to us by the buyer in writing within 24 hours after these defects come to light.<\/p><p><strong>15. <\/strong><strong>GENERAL<br \/><\/strong>If a provision of these General Terms and Conditions is not valid or not permissible, this does not limit the operation of the other provisions. We may change or otherwise edit these General Terms and Conditions over time without prior notice. Please check our website regularly to see which General Terms and Conditions currently apply.<\/p><p><strong>16. APPLICABLE LAW<br \/><\/strong>Belgian law applies to all our agreements. All disputes arising from the agreements to which the present conditions apply shall, subject to the competence of the cantonal judge in cases regulated by law, be settled by the competent court in Antwerp. In deviation from the foregoing, the provisions of the Vienna Sales Convention apply to international transactions, while maintaining the competence of the district court in Brussels or the cantonal judge.<\/p><p><strong>17. ONLINE DISPUTE RESOLUTION<br \/><\/strong>The European Commission offers a platform for online dispute resolution for consumers, which you can find at https:\/\/ec.europa.eu\/consumers\/odr\/.
